UN report: Israel has established an 'apartheid regime'

Report breaks new ground on the UN's examination of the situation in occupied Palestine by using the word 'apartheid'.

A new United Nations report accuses Israel of having established "an apartheid regime that oppresses and dominates the Palestinian people as a whole".

The publication comes amid renewed debate about whether, through its settlement policy and rejection of Palestinian self-determination, the Israeli government is creating - or even has already created - a de facto "one-state", which critics warn would constitute a form of apartheid.

It urged governments to "support boycott, divestment and sanctions [BDS] activities and respond positively to calls for such initiatives".

The report - Israeli Practices towards the Palestinian People and the Question of Apartheid - was commissioned and published by the UN Economic and Social Commission for Western Asia (ESCWA) and launched in Beirut.

John Reynolds, a lecturer in law at the National University of Ireland, Maynooth, told Al Jazeera the report "breaks new ground in the context of the UN's analysis of the situation in Palestine".

Israel's UN envoy Danny Danon issued a statement condemning the report late on Wednesday.

"The attempt to smear and falsely label the only true democracy in the Middle East by creating a false analogy is despicable and constitutes a blatant lie," he said.

UN spokesman Stephane Dujarric, when asked about the report, said it was published without any prior consultations with the UN Secretariat and its views do not reflect those of the secretary-general.

The report was authored by two critics of Israeli state practice: Virginia Tilley, professor of political science at Southern Illinois University, and Richard Falk, former UN special rapporteur on the situation of human rights in the Palestinian territories, and professor emeritus of international law at Princeton University.

Noting how "the expert consensus [is] that the prohibition of apartheid is universally applicable and was not rendered moot by the collapse of apartheid in South Africa", the report argues that Israel is "guilty of policies and practices that constitute the crime of apartheid", a "crime against humanity under customary international law and the Rome Statute of the International Criminal Court".

The report is a "detailed analysis of Israeli legislation, policies and practices" that highlights how Israel "operates an apartheid regime", including through "demographic engineering".

Palestinian citizens of Israel are described as "subjected to oppression on the basis of not being Jewish", it said.

Palestinians in East Jerusalem similarly experience "discrimination in access to education, healthcare, employment, residency and building rights", as well as "expulsions and home demolitions".

Palestinians in the West Bank and Gaza Strip are governed by "military law" alongside Jewish settlers "governed by Israeli civil law", the report said.

Palestinian refugees and exiles are "prohibited from returning to their homes in Israel and the occupied Palestinian territory" on the basis that they "constitute a 'demographic threat' and that their return would alter the demographic character of Israel".

As well as urging governments to back BDS, the report recommends that the UN and its member states should "revive the Special Committee against Apartheid, and the United Nations Centre Against Apartheid (1976-1991)", which would then "report authoritatively on Israeli practices and policies relating to the crime of apartheid".

The report also suggests an advisory opinion be sought from the International Court of Justice "as to whether the means used by Israel to maintain control over the Palestinian people amount to the crime of apartheid".

David Keane, associate professor in law at Middlesex University, said the new report differs from previous ones on the subject because it "expressly attaches the apartheid label".

OPINION: Israeli Labor Party adopts the apartheid mantra

The report could contribute to an already deteriorating relationship between the government of Israeli Prime Minister Benjamin Netanyahu and the United Nations.

"For Palestinians and their allies, the report will help to provide a solid basis for their work," Nadia Hijab, executive director of al-Shabaka - The Palestinian Policy Network - told Al Jazeera .

Citing the reputation and credibility of the authors, Hijab described the report as "a clear, concise document" whose recommendations are "timely and much needed".

Just one of the many attacks on Palestinians yesterday. The day before Israel drone blew up an electricity station in Gaza, even though Gazan still get many days without electricty because of 2014.


Settlers attack Nablus area school with gunfire

NABLUS, March 16, 2017 (WAFA) – Israeli settlers on Thursday opened gunfire towards a Palestinian secondary school in the village of Burin, south of Nablus in the occupied West Bank, according to local sources.

Ghassan Daghlas, who monitors settlement activities in the area, told WAFA that a group of Israeli settlers opened gunfire towards the school to intimidate the students. There were no reports of injuries, however.

The settlers also took pictures of the school before they left the scene.

Violence by illegal Jewish settlers is commonplace. They have repeatedly attacked Palestinian property and worship places. Settler violence includes property and mosque arsons, stone-throwing, uprooting of crops and olive trees, and attacks on vulnerable homes, among others.

Trump and the RW Israeli lobby forced the UN to remove the Israel apartheid report which of course came on the back of Trump threatening to slash UN funding. Pretty much do as you are told or else. The UN did take it down but the UN made it quite clear that they didn't have a problem with the content just the publication process. THe problem for Trump and the Israely RW is that they can't put the genie back in the bottle.

And this is the man who wrote it. He is Jewish, but because he disagrees with the apartheid police of Israel, they bring out the old chestnut - anti semite. According the them, there are huge numbers of Jews in the world who disgree with them and are therefor anti semite. They are truly nuts.

And for the eyes of the RW ranters the UN has already declared that the West Bank settlements are in contravention of International law. And that's from the current UN general secretary Antonio Guterres so there can be no doubt he was forced to have the report removed with his arm up his back

The Israeli parliament's move to legalize thousands of settler homes in the occupied West Bank goes against international law and will have legal consequences for Israel, United Nations Secretary-General Antonio Guterres was quoted as saying on Tuesday.

Palestinians have condemned the legislation approved by Israeli lawmakers on Monday as a blow to their hopes of statehood, but its passage may only be largely symbolic as it contravenes Israeli Supreme Court rulings on property rights.

The legislation retroactively legalizes about 4,000 settler homes built on privately owned Palestinian land.

"The Secretary-General deeply regrets the adoption of the (bill) ... This bill is in contravention of international law and will have far-reaching legal consequences for Israel," Stephane Dujarric, spokesman for Guterres, said in a statement.

Well, lets hope the courts deal with them the same way they dealt with the settlement on the other thread I started, where they have made the settlers leave. Now that would be justice.

There won't be, Catman. The Israeli government says so and they even put it on their website. It's their charter to deny the existence and formation of a Palestinian state. They want it all and that's it.

I don't think situations where white phosphorus is dropped on children, and people burn babies alive can ever be classed as a side issue. The Israeli's have done both.

And isn't it astonishing that someone who denies that Israel engages in apartheid and claims the report is false also has no problem using material from a white supremacist organisation that wants to create a seperate state for themselves in South Africa. Back to aparheid there against everything that Mandella fought against?

Shocking and appaling doesn't even get near how bad that is.

I have never understood how countries (including us) allow people to go and join the IDF (if they didn't there wouldn't be much IDF), because when they join they have to swear an oath of allegiance to Israel. How can that be right?;

The denialists are out in force even though they see for themselves how bad this is. It's just too much for them to accept the real truth of what is going on and just how bad things are getting.
It's a constant fight against the RW media but the world at large is waking up to the reality and the truth and more and more the tide is turning which is a shame because there are many good people in Israel who are increasingly unhappy of the way Netanyahu and his government are behaving with their policies.
